En este artículo se examina el delito de aborto establecido en el artículo 122 del código penal y la posibilidad de que en Colombia se utilicen otras formas de terminar la acción penal, evitando así imponer penas o medidas de seguridad. Si bien actualmente no hay forma de impedir la penalización en todos los casos de una conducta punible como el aborto, sí es posible lograrlo a través del procedimiento penal aplicando el principio de oportunidad que se encuentra consagrado en los artículos 321 y siguientes del código de procedimiento penal y regulado en el decreto 4155 de 2016. Cuando el proceso penal termina con una pena o sanción se apologiza el clásico derecho penal retributivo, y en este escrito se aboga por recurrir a la reparación o a la aplicación del principio de oportunidad, las que son una tercera vía del derecho penal.
En este trabajo para tal efecto se reúne la jurisprudencia más relevante de la Corte Constitucional y de la Corte Suprema de Justicia respecto al delito de aborto y se atiende a lo resaltado tanto en la doctrina nacional como en la internacional sobre el principio de oportunidad, lo cual conlleva a enaltecer el debate interno sobre el delito de aborto y si penalizarlo o no, lo que servirá de apoyo en igual sentido en el ámbito internacional.
Se concluye que, ante delitos inanes como el aborto, el principio de oportunidad es el mejor balance entre justicia y capacidad del sistema penal y es en ultimas una tercera vía del derecho penal.
This article examines the crime of abortion established in article 122 of the penal code and the possibility that in Colombia other ways of ending the criminal action are used, thus avoiding imposing penalties or security measures. Although currently there is no way to prevent the criminalization in all cases of punishable conduct such as abortion, it is possible to achieve it through criminal procedure applying the principle of opportunity that is enshrined in articles 321 and following of the code of procedure. criminal and regulated in decree 4155 of 2016. When the criminal process ends with a penalty or sanction, the classic retributive criminal law is apologized, and in this document we advocate recourse to reparation or the application of the principle of opportunity, which are a third way of criminal law.
In this work, for this purpose, the most relevant jurisprudence of the Constitutional Court and the Supreme Court of Justice regarding the crime of abortion is brought together, and what is highlighted in both national and international doctrine on the principle of opportunity, which leads to enhance the internal debate on the crime of abortion and whether to penalize it or not, which will serve as support in the same sense in the international arena. It is concluded that, when faced with inane crimes such as abortion, the principle of opportunity is the best balance between justice and the capacity of the penal system and is ultimately a third way of criminal law.
