Se estudia en este artículo la intervención del llamado «Derecho Penal del Enemigo», en la restricción de derechos que se aplican a los detenidos por delitos de terrorismo, en concreto la detención incomunicada. El autor del artículo analiza los antecedentes internacionales, la jurisprudencia y las reformas procesales, para clarificar el resurgir de la teoría de Günther Jakobs, en los delitos previstos en el Código Penal y el procedimiento procesal español.
The intervention of the called «Penal Law of the Enemy» is studied in this article, in the restriction of the rights which are applied to terrorism arrested, especially the non-communicated arrested. The author of this article analyses the international precedent events, jurisprudence and procedural remodelling, to clarify the comeback of Günther Jakob’s theory in the penal process and Spanish one.
