El teletrabajo representa un fenómeno actual en el contexto laboral internacional a raíz de la crisis sanitaria de la Covid-19. Cuba, como algunos países se ha sumado a la reciente tendencia de regular jurídicamente el teletrabajo. En el caso cubano entró en vigor en agosto de 2021 el Reglamento de Teletrabajo y trabajo a distancia para abordar las principales particularidades de esta forma de organización del trabajo. Sobre esta basa y, a partir de un estudio comparado con la regulación de otros países y organizaciones internaciones se realiza un análisis sobre los principales elementos teóricos y normativos que posee la norma y aquellos en los que se debe profundizar desde los debates doctrinales más contemporáneas sobre el teletrabajo. El artículo estudia la definición del teletrabajo, sus elementos, el ámbito de aplicación objetivo y subjetivo de la norma, las formalidades y los principios jurídicos que deben informar el régimen jurídico del teletrabajo.
Teleworking represents a current phenomenon in the international labor context as a result of the Covid-19 health crisis. Cuba, like some countries, has joined the recent trend of legally regulating teleworking. In the Cuban case, the Telework and Distance Work Regulations came into force in August 2021 to address the main particularities of this form of work organization. On this basis and, based on a study compared with the regulation of other countries and international organizations, an analysis is carried out on the main theoretical and normative elements that the norm has and those in which it must be deepened on the basis of doctrinal debates more contemporary about teleworking. The article studies the definition of telework, its elements, the scope of objective and subjective application of the standard, the formalities and legal principles that should inform the legal regime of telework.
