El Impuesto sobre Bienes Inmuebles es la principal figura impositiva de la Hacienda Local. De carácter directo, real y objetivo, su cuota tributaria es el resultado de aplicar al valor catastral del inmueble el correspondiente tipo de gravamen. Los tipos mínimos y máximos para cada tipo de inmueble son fijados por el legislador estatal, y cada municipio, mediante su respectiva Ordenanza fiscal, puede escoger el más adecuado dentro de los límites previstos. El artículo 72.4 del TRLRHL prevé que dentro de la horquilla de tipos, puedan aprobarse tipos diferenciados para los bienes inmuebles de naturaleza urbana excluidos los de uso residencial. A tenor de las medidas introducidas en algunos municipios nos preguntamos si estos tipos diferenciados deben ser incrementados o también podrían ser reducidos, y para intentar resolver esta cuestión abordamos de manera integral una regulación que consideramos compleja y con importantes carencias que resulta urgente revisar
The Property Tax is the main tax figure of the Local Treasury. Of a direct, real and objective nature, the tax quota is the result of applying the corresponding tax rate to the cadastral value of the property. The minimum and maximum rates for each type of property are set by the state legislator, and each municipality, through its respective fiscal ordinance, can choose the most appropriate within the limits provided. The article 72.4 of the TRLRHL provides that within the range of rates, differentiated rates may be approved for urban nature property, excluding those for residential use. In view of the measures introduced in some municipalities, we ask if these differentiated rates should be increased or could also be reduced, and to try to resolve this question we analyze a complex and deficiency regulation that it is urgent to review.
