La utilización de la tecnología «Blockchain» constituye, a día de hoy, una avanzada herramienta tecnológica que debe ser acogida en el ámbito jurídico. Ya se ha realizado en otros sectores, como el Fintech, Health-tech, Adtech o el de telecomunicaciones, por lo que sectores como el Legaltech o el Regtech no deben quedarse atrás, máxime teniendo presente la utilidad práctica que brindan en el ámbito de la contratación. La tecnología «Blockchain», dadas sus especiales características, otorga confianza a los usuarios, seguridad en las transacciones, trazabilidad de las operaciones y automaticidad en la contratación y en su ejecución. Por tanto, resulta necesario resaltar su aplicación jurídica, tanto en el ámbito civil con la figura de la contratación inteligente, como su aconsejable implementación en el ejercicio de la función jurisdiccional.
The use of «Blockchain» constitutes, today, an advanced technological tool that should be included in the Civil legal field. It has already been done in other sectors, such as Fintech, Health-tech, Adtech or telecommunications. This means that sectors such as Legaltech or Regtech should not fall behind, especially bearing in mind the practical utility they provide in the field of contracting. «Blockchain» technology, given its characteristics, grants users confidence, security in transactions, traceability of operations, and automaticity in contracting and its execution. Therefore, it is necessary to highlight its legal application, both in the Civil Law with the figure of «Smart Contracting», as well as its implementation in the field of the jurisdictional function.
