El objeto del presente trabajo es el análisis de la resolución del TJUE de 3 de marzo de 2022, Acacia y BMW, C-421/20. En la cuestión prejudicial se plantea, en esencia, cuál es la ley aplicable a las pretensiones conexas a una acción por infracción de dibujos o modelos comunitarios de carácter selectivo a la luz del Reglamento Roma II, que regula la ley aplicable a las obligaciones extracontractuales, y del Reglamento sobre dibujos y modelos comunitarios. El TJUE aclara, a tal fin, la interpretación del artículo 8.2 del Reglamento Roma II ofreciendo los criterios aplicables para establecer la localización del lugar en el que se ha cometido la infracción, y su encaje con el Reglamento sobre dibujos y modelos comunitarios. En la Sentencia el TJUE simplifica su Jurisprudencia previa al respecto y se separa de las Conclusiones del Abogado General que conducirían a obtener una resolución diametralmente opuesta.
The purpose of this paper is to analyse the decision of the Court of Justice of the European Union of 3rd March 2022, Acacia and BMW, case C-421/20. The question referred for a preliminary ruling essentially concerns the law applicable to claims relating to an action for infringement of Community designs in the light of the Rome II Regulation, which governs the law applicable to non-contractual obligations, and the Community Design Regulation. To this end, the CJEU clarifies the interpretation of Article 8(2) of the Rome II Regulation, offering the criteria applicable to establish the location where the infringement has been committed, and how it fits in with the Community Design Regulation. In the decision, the CJEU simplifies its previous case law on the matter and departs from the Advocate General’s Opinion, which would lead to a diametrically opposed decision.
