La Ley de Residuos impone a las entidades locales el establecimiento de una tasa o tarifa coactiva por el servicio de recogida de residuos. Se trata de un mandato claro que induce a sostener que estamos ante una tasa o tarifa de establecimiento obligatorio, hasta el punto de que su incumplimiento es susceptible de legitimar la subrogación del Estado o de la Comunidad autónoma en la aprobación de la ordenanza local. Sin embargo, la dificultad en tal subrogación y. sobretodo, la circunstancia de no anudar el legislador sectorial ninguna consecuencia jurídica al incumplimiento de este mandato, nos llevan a la conclusión de que el establecimiento de la tasa o tarifa es potestativo estando, pues, ante un mandato programático cuyos efectos jurídicos se limitan a servir de guía a la actuación local y de criterio interpretativo de la normativa vigente. Lo cual resulta relevante a la hora de concretar los distintos trámites del procedimiento de elaboración y aprobación de la ordenanza reguladora, ya de la tasa, ya de la tarifa coactiva.
The Waste Law imposes on local entities the establishment of a coercive rate or tax for the waste collection service. It is a clear mandate that leads us to maintain that we are facing a rate or tax whose establishment is mandatory, to the point that its non-compliance is prone to legitimize the subrogation of the State or the Autonomous Community in the approval of the local ordinance. However, the difficulty in such subrogation and, especially, the circumstances stemming from not subjecting the sectoral legislator to any legal consequences if he/she breaches this mandate, leads us to the conclusion that the establishment of the rate or tax is facultative, being, therefore, a programmatic mandate whose legal effects are limited to serve as a guide to local action as well as interpretive criteria of current regulations.
This is relevant when determining the procedural steps associated with the formulation and approval of the regulatory ordinance, either of the tax, or of the coercive rate.
