La STC 81/2020, de 15 de julio, ha puesto de relieve nuevamente el conflicto competencial que existe en relación con el alcance de la regulación autonómica en materia de Derecho de obligaciones y contratos. En este caso, el debate se ha planteado desde la perspectiva de la protección animal, al introducir las normas autonómicas limitaciones que afectan tanto al objeto de los contratos, como a los sujetos de los mismos. A partir de tales premisas, el presente estudio tiene por objeto la determinación competencial de los elementos esenciales del contrato que afectan a la protección animal, así como el tratamiento que se ha venido dando por las Comunidades Autónomas.
Asimismo, se analizan las novedades que emergen de la reciente legislación estatal sobre la materia, así como sus implicaciones en el ámbito de la distribución de competencias legislativas sobre protección animal.
The STC 81/2020, of l Sth july, has once again highlighted the conflict of competence that exists over the law of obligations and contracts in rhe autonomous regulations. In rhis case, rhe debate has arisen from the perspective of animal protection, insofar as the autonomous regulations introduce lirnitarions that affect borh the object of the conrracts and their subjects. Based on these premises, the aim of rhis study is to determine the competence of these issues that affect animal protection, as well as the treatment that has been given by the autonomous communities. Likewise, the aim is to analyse the new perspectives emerging in state legislation, as well as their implications with regard to rhis specific issue.
