I problemi derivanti dalla combinazione tra l'art. 56 c.p. e le diverse tipologie delittuose sono numerosi e spesso discordanti, quando non opposti, sono gli orientamenti interpretativi che li riguardano. L'attenzione rivolta al tema è in generale abbastanza limitata, forse anche perché il rilievo pratico delle relative questioni non è elevatissimo dal punto di vista quantitativo. Tuttavia, proprio la natura controversa dei profili applicativi offre una prospettiva particolarmente utile per verificare la tenuta di premesse teoriche date a volte per scontate. Nello scritto vengono dunque analizzate alcune delle questioni appartenenti a quell'area problematica, scelte in ragione della loro spiccata attitudine a rappresentare con particolare immediatezza il tipo di problemi che si generano a seguito del contatto tra l'art. 56 c.p. e i diversi modelli delittuosi presenti nel sistema.
The problems arising from the combination of art. 56 of the Italian Criminal Code and the different types of criminal offenses are numerous, and there are often conflicting, if not opposite, interpretative orientations concerning them. The attention paid to the topic is generally quite limited, perhaps also because the practical relevance of the related issues is not very high from a quantitative point of view. However, it is precisely the controversial nature of the applicative implications that offers a particularly useful perspective for establishing the degree of soundness of theoretical premises, which, sometimes, are taken for granted. The issues analyzed in this paper were chosen because they are extremely and clearly indicative of the type of problems arising from the combination of art. 56 of the Italian Criminal Code and the various criminal models envisaged in the system.
