An Act has been recently passed by the Italian Parliament to enforce the rule of speedy proceedings in the criminal justice system (the so-called “Cartabia” reform, after the name of the Ministry of Justice). A totally new approach has been adopted to strengthen the defendants' right to have their case adjudicated in a reasonable timeframe. As a result, speediness is no longer a matter of efficiency, but a pivotal task to be continuously performed by judicial officers watching over the machinery of justice to protect the defendant's right. A new motion is granted to defendants to challenge the exceeding of the time limits established by law to terminate trials pending before the Court of Appeal or the Supreme Court. Furthermore, the “Cartabia” reform tries to improve the process for committing defendants for trial, but the new Act should be reviewed so as to ensure the enforcement of a more satisfactory filter based upon a control of the charges filed by the prosecutor. Conversely, what is truly appreciable is the new trend to entrust a preliminary screening of the probable cause to a judge serving in the same court which will be vested with the responsibility of ruling over the merits of the case.
La riforma Cartabia, sfociata nella legge delega n. 134/2021, attribuisce una posizione di primo piano alla ragionevole durata del processo penale. Essa viene non solo disciplinata, ma anche sorretta da un apparato di misure che garantiscono il monitoraggio permanente dei tempi del processo. Nasce così una vera cultura della speditezza che sancisce il valore di garanzia delle norme sui tempi del processo, sottratte alla visuale riduttiva del mero efficientismo. Per quanto riguarda la nuova improcedibilità per superamento dei termini stabiliti per i giudizi di appello e di cassazione, si deve prendere atto che questa forma di invalidità opera solo in relazione alla fase della impugnazione in cui si manifesta e non può retroagire al momento dell'esercizio dell'azione penale come si ritiene invece erroneamente estendendo a questo vizio un regime analogo a quello della prescrizione. Un particolare impegno è necessario nella attuazione della delega in tema di udienza preliminare per superare la regola di giudizio creata per il non luogo a procedere. Una scelta felice è invece quella del « filtro intraneo » per i reati previsti dall'art. 550 c.p.p, con previsione di un controllo sulla apertura del giudizio da espletare nella sede predibattimentale.
