Las leyes arcaicas del derecho romano reconocen el testamento como un acto jurídico y formal. Se cree que la palabra testamento tiene una base en la voz latina “testis” que significa “testigo”. De esta manera, el testamento se convierte no sólo en expresión de las últimas voluntades del legador, sino también en su testigo físico. El testamento abierto notarial es el único instrumento por el cual dejamos documentado, quiénes serán los beneficiarios de nuestro patrimonio una vez que fallezcamos. En el pasado, sin embargo, esto no ocurría así. Es posible hacer testamento válido en pleno confinamiento y sin acudir al notario. No obstante, este testamento deberá cumplir unos requisitos legalmente establecidos, para su eficacia.
The archaic laws of Roman law recognize the testament as a formal and legal act. The word testament is believed to have a basis in the Latin voice which means “witness”. In this way, the testament becomes not only an expression of the testator last wishes, but also his physical witness. The open notarial will is the only instrument by which we leave documented, who will be the beneficiaries of our heritage once we die. In the past, however, this was not the case. It is possible to make a valid will in full confinement and without going to the notary. However, this testament must meet legally established requirements for its effectiveness.
