La última reforma laboral llevada a cabo por el RD-Ley 32/2021 vuelve a intentar ordenar la estructura de la negociación colectiva mediante la modificación “quirúrgica” de la concurrencia de convenios colectivos en una cuestión tan sensible como es la cuantía salarial. Revierte así una de las medidas estrella de la reforma laboral de 2012, negando la prioridad aplicativa al convenio de empresa posterior en esta materia. Al tiempo, establece unos plazos de adaptación a la nueva configuración convencional y trata de aclarar el acuerdo que debe regir las condiciones laborales en contratas y subcontratas, incluidas, claro está, las empresas multiservicios.
The latest labour reform carried out by RD-Law 32/2021 once again attempts to organise the structure of collective bargaining by means of a “surgical” modification of the concurrence of collective agreements on such a sensitive issue as the amount of wages. Therefore reverses one of the star measures of the 2012 labour reform, denying priority of application to the subsequent company agreement in this matter. At the same time, it establishes deadlines for adapting to the new collective configuration and attempts to clarify the agreement that should govern working conditions in outsourcing, including, of course, multiservice companies.
