Este trabajo quiere examinar la nueva ley en el contexto de la economía circular. Las políticas preventivas, la no-generación de residuos, serían los objetivos primordiales para avanzar en la circularidad. Resintonizar la legislación de residuos para que los actores implicados adopten esas prácticas preventivas y sean penalizados por las que no lo sean, debería ser la consecuencia. En qué medida esto se consigue en el nuevo texto legislativo es el objeto de este análisis: contextualizar las previsiones de la nueva ley de residuos en función de su contribución a la economía circular y, por tanto, a la sostenibilidad global.
This paper wants to examine the new law in the context of the circular economy. Preventive policies, non-generation of waste, should be the primary objectives to advance in circularity. Retuning waste legislation so that the actors involved introduce preventive actions and are penalized for those that are not, should be the consequence. To what extent this is achieved in the new legislation is the object of this analysis: contextualizing the provisions of the new waste law based on its contribution to the circular economy and, therefore, to global sustainability.
