La prostitución de menores constituye un fenómeno del que ningún país ha estado exento y que influye en el crecimiento de los mismos, quebrantando gravemente su libertad e indemnidad sexual. Los estados han desplegado herramientas de prevención e intervención sin evitar que se cometan actos tan polémicos como el de las menores tuteladas por determinadas administraciones públicas españolas. En este sentido, el CP ha sido objeto de diversas modificaciones ocasionadas por los distintos tratados o normas de carácter supranacional, dando lugar a un tipo delictivo que no ha estado exento de debate. Tras la aprobación de la Ley 8/2021, de 4 de junio, se hace necesario analizar si la reforma que ha generado en el Código Penal ha incorporado, suprimido o modificado los principales problemas dogmáticos en el delito de prostitución de menores.
The prostitution of minors constitutes a phenomenon from which no country has been exempt and which influences their growth, seriously undermining their freedom and sexual indemnity. The states have deployed prevention and intervention tools without preventing such controversial acts from being committed, such as that of minors under the guardianship of certain Spanish public administrations. In this sense, the CP has been subject to various modifications caused by the different treaties or norms of a supranational nature, giving rise to a type of crime that has not been exempt from debate. After the approval of Law 8/2021, of June 4, it is necessary to analyze whether the reform that it has generated in the Penal Code has incorporated, suppressed or modified the main dogmatic problems in the crime of prostitution of minors.
