Ante unos hechos acreditados de relación laboral simulada (como consecuencia de protocolo firmado entre agentes sociales y entidades públicas), el trabajador alega (aparte de algún otro motivo formal) que se debe tener por existente la relación laboral y, por tanto, debe mantenerse su derecho a la protección por desempleo, en base a la inexistencia de dolo o negligencia por su parte y al principio de confianza legítima. El tribunal, analizando el contexto del ordenamiento jurídico, responde en síntesis que, en primer lugar, lo relevante a efectos de la prestación por desempleo no es si el trabajador participó en el fraude, sino el hecho de que no existió la relación laboral; y, en segundo lugar, que no puede nacer confianza legítima de la inexistencia de relación laboral, ni el Servicio Público de Empleo tuvo ninguna participación a la simulación de la misma.
Faced with accredited facts of a simulated employment relationship (as a result of a protocol signed between social agents and public entities), the worker alleges (apart from some other formal reason) that the employment relationship must be considered to exist and, therefore, his right to unemployment protection must be maintained, based on the absence of intent or negligence on their part and the principle of legitimate expectations. The court, analyzing the context of the legal system, answers in summary that, first of all, what is relevant for the purposes of the unemployment benefit is not whether the worker participated in the fraud, but the fact that the employment relationship did not exist ; and, secondly, that legitimate expectations cannot arise from the non-existence of an employment relationship, nor did the Public Employment Service have any involvement in the simulation thereof.
