El presente comentario a la STS trata de situar la posición del Tribunal Supremo en relación con la necesidad de someter los instrumentos de planeamiento a la declaración de impacto ambiental y, en especial, si dicha obligación alcanza incondicionalmente a cualquier modificación de los mismos cualquiera que se sea el alcance y el contenido de la modificación. La posición del Tribunal Supremo, en esta sentencia, es que la formulación legal taxativa y no diferenciadora de contenido alguno debe, sin embargo, interpretarse en el marco de la Directiva comunitaria que transpone y que, por tanto, la obligación debe modularse en función de que el contenido de la modificación del instrumento de planeamiento contenga o no determinaciones sustantivas que puedan afectar al medioambiente.
