El propósito del trabajo es el análisis de la Ley 3/21 de regulación de la eutanasia desde un punto de vista iuspublicista y administrativista. En primer lugar, se analiza la ponderación de derechos que la Ley presupone. En segundo lugar, es necesario referirse al dilema existente entre la decisión por parte de las autoridades médicas y su control judicial, como una muestra del modelo de decisión tecnocrática y sus problemas. Su configuración como derecho prestacional también será objeto de análisis, así como el carácter dispositivo del derecho a la vida a través de la mediación estatal. Además, habrá que hacer mención al concepto de contexto situacional que la Ley recoge, insertándolo en un análisis más amplio acerca el problema de la decisión libre en un cotexto dependiente de las alternativas sanitarias que ofrece un sistema de salud pública cada vez más degradado e infrafinanciado y el posible conflicto de intereses resultante de esta situación. Por último, se ralizarán algunas observaciones en relación con la ejecución de la prestación, la objeción de conciencia y el registro de las muertes por eutanasia.
The purpose ofthis article is the analysis of the Statute 3/21 of euthanasia of Spain from an iuspublicist and administrative point of view.
First of all, will be anaJysed the rights balance presupposed by the law. Secondly is to be considered the dilemma between the medical decision of medical authorities and its judicial control as a symptom of a technocratic decision model and its problems. Thirdly will be analysed the configuration of euthanasia as a right to social benefit, the effects on the right to life and the mediation role of state. Another important point refers to the legal concept of situational context, which must be considered taking into account the problem of free decision depending on health care alterna tives in an infrafinanced health care system and the possible conflict of interests that this situation can cause. Finally, some words will be written regarding the execution of the benefit, the right to conscientious objection and the registration of the deaths produced by the application of euthanasia.
