Los juicios telemáticos suponen un verdadero cambio o transformación en la forma de resolver los conflictos, alterando el sistema judicial y provocando así una nueva forma de entender la administración de la justicia. En este artículo partimos de que la eficacia del proceso se presenta como una máxima necesaria para los justiciables, nosotros mismos debemos exigir que éste se lleve a cabo mediante medios eficientes para que sus derechos e intereses queden protegidos y se les ofrezca una verdadera tutela judicial efectiva. De esta forma la introducción de las TICs en la Administración de Justicia puede contribuir a alcanzar esa ansiada justicia de calidad, abierta, transparente y próxima al ciudadano, pero que al mismo tiempo vendrá acompañada inevitablemente de una modificación de determinadas garantías y principios procesales. Con la pandemia, el objetivo de avanzar hacia una informatización cada vez más integral y completa del sistema judicial es ya una realidad imparable a la que, queramos o no, tendremos que adaptarnos. Ante ello, nos encontramos ante un compendio de textos legales sumamente importante para la instauración de una eficiente y eficaz Administración de Justicia informatizada completamente necesaria para que los juicios telemáticos sean una realidad durante tiempos de pandemia. Sin este soporte legal tan amplio, no hubiera sido posible introducir esta modalidad durante los dos últimos años en nuestro sistema procesal, puesto que para que el juicio oral se pueda virtualizar, todo el procedimiento de gestión y tramitación que le precede debe también encontrarse en una modalidad informática compatible. Así, a lo largo del presente estudio abordaremos el tratamiento jurídico actual y futuro del encaje de las vistas telemáticas en el juicio oral desde una perspectiva garantista.

In this way, the introduction of ICTs in the Administration of Justice can contribute to achieving this longed-for quality justice, which is open, transparent and close to the citizen, but at the same time it will inevitably be accompanied by a modification of certain procedural guarantees and principles. With the pandemic, the objective of moving towards an increasingly comprehensive and complete computerisation of the judicial system is already an unstoppable reality to which, whether we want to or not, we will have to adapt. We are therefore faced with a compendium of legal texts that are extremely important for the establishment of an efficient and effective computerised administration of justice, which is completely necessary for telematic trials to become a reality in times of pandemic. Without this broad legal support, it would not have been possible to introduce this modality during the last two years in our procedural system, given that for the oral trial to be virtualised, the entire management and processing procedure that precedes it must also be in a compatible computerised modality.
