Las potestades urbanísticas y de ordenación del territorio se han erigido en los últimos años como una herramienta de las administraciones locales para frenar el impacto las actividades turísticas en su territorio. El uso de estas competencias ha generado serias dudas especialmente a la luz de la normativa comunitaria y los principios de libertad de establecimiento y la libre prestación de servicios en el mercado interior. Sin embargo, la jurisprudencia ha avalado estas técnicas regulatorias urbanísticas, apreciando que la lucha contra la escasez de la vivienda o la protección del entorno urbano son razones imperiosas de interés general que permiten la imposición de restricciones sobre las actividades económicas. Estamos ante mecanismos de lucha contra la gentrificación de las ciudades y herramientas que tratan de garantizar el derecho a la vivienda digna. El presente artículo expone los principales aspectos de la jurisprudencia en la materia.
The powers about urban and land-use patterns have emerged in recent years as a tool for local administrations to curb the impact of tourist activities in their territory. The use of these competencies has raised serious doubts, especially considering Community regulations and the principles of freedom of establishment and the freedom to provide services in the internal market. However, jurisprudence has endorsed these urban regulatory techniques, appreciating that the fight against the rental housing shortage or the protection of the urban environment are overriding reasons related to the public interest that allows the imposition of restrictions on economic activities. We are facing mechanisms to fight the gentrification of cities and tools that try to guarantee the right to decent housing. This article sets out the main aspects of jurisprudence on the matter.
