Los altos estándares probatorios en el sistema penal acusatorio exigen calidad en la investigación y durante todas las etapas procesales, mucho más cuando se trate de acreditar una de las formas más graves de delincuencia trasnacional de la actualidad: la delincuencia organizada. Una de las más eficaces estrategias para evitar la impunidad de esta modalidad delincuencial se logra si el Fiscal acusador cuenta con el dominio de la teoría del delito, las etapas del proceso penal donde debe intervenir con la ética y los principios del sistema acusatorio oral y las técnicas para encontrar y desahogar los datos de prueba necesarios en las audiencias orales; solo así el juez sentenciará siempre que deje atrás cualquier duda razonable.Entender el estudio dogmático del tipo penal de delincuencia organizada es una estrategia básica para evitar la impunidad.
The high evidentiary standards in the accusatory criminal system require quality in the investigation and during all procedural stages, much more when it comes to proving one of the most serious forms of transnational crime today: organized crime. One of the most effective strategies to avoid impunity for this criminal modality is achieved if the accusing Prosecutor has mastery of the theory of the crime, the stages of the criminal process where he must intervene with the ethics and principles of the oral accusatory system and the techniques to find and release the necessary evidence in oral hearings; only then will the judge sentence as long as he leaves behind any reasonable doubt. Understanding the dogmatic study ofthe criminal offense of organized crime is a basic strategy to avoid impunity.
