El Gobierno ha establecido una serie de restricciones específicas para limitar las posibilidades de despido de trabajadores durante la pandemia, entre ellas la conocida como prohibición de despido COVID. Pero su mantenimiento a lo largo del tiempo ha hecho que haya ido perdiendo razonabilidad y sentido. Con esta prohibición se insiste en la idea de que las empresas deben gestionar sus dificultades por la vía de las suspensiones contractuales o reducciones de jornadas, no de las extinciones de contratos. Por ello se impone una interpretación de esta restricción acorde con la realidad vigente. Así, el contexto COVID puede justificar decisiones extintivas lícitas ex arts. 54 y 52 Estatuto de los Trabajadores, pero también puede servir para fundamentar despidos objetivos y colectivos por causas económicas/técnicas, pese a la prohibición de despido cuando el nivel de consolidación de las dificultades empresariales adquiere tal envergadura que gana autonomía respecto del virus y deja de ser una situación temporal o coyuntural justificativa del ERTE. El propósito que sustenta esta comunicación es precisamente hacer balance de esta realidad y situar en sus justos términos la limitación indicada, a fin de garantizar la viabilidad futura de nuestras empresas.
The government has put in place a number of specific restrictions to limit the possibilities for dismissal of workers during the pandemic, including the unlawful dismissal on ground of covid. But their maintenance over time has meant that they have become increasingly unreasonable and meaningless. This prohibition insists on the idea that companies should manage their difficulties by means of contractual suspensions or reductions in working hours, not by terminating contracts, But that is why an interpretation of the dismissal restriction that is in line with this reality is necessary. The COVID context can justify laMul dismjssal decisions ex arts. 54 and 52 Workers' Statute, but it can also serve to justify objective and collective dismissals for economic/technical reasons, despite the prohibition of dismissal when the level of consolidation of the business difficulties becomes so great that it gains autonomy from the virus and ceases to be a temporary or circumstantial situatjon justifying the temporary file. The purpose of this communication is precisely to take stock of this reality and to place the aforementioned limitation in its proper terms, in order to guarantee the future viability of our companies.
