La discusión acerca de cómo la o el niño judicializado debe responder por los hechos delictivos cometidos genera dos posiciones dominantes: Una en que se exige una especial penalización mientras que desde la otra, se solicita responsabilización social y psicológica. Este artículo discute ambas posturas en busca de una síntesis proponiendo garantizar juicios justos coartando la tradicional discrecionalidad judicial en este campo pero, a la par, rechaza todo sistema de penas especiales como vía para la construcción de responsabilidad social y subjetiva.
The discussion about how the child taken to court must be responsible for the committed criminal felonies generates two predominant positions: On the one hand, a special punishment is demanded, whereas, on the other, social and psychological responsibility is requested. This article discusses both positions in search of a synthesis proposing to guarantee fair judgments restricting the traditional law discretion in this area but, at the same time, it rejects any system of special punitive acts as a means of the construction of social and subjective responsibility.
