Kelsen stands as the only positivist theorist with a coherent theory of international law. While others like Austin and Hart continued to doubt the legal character of international law, Kelsen ventured to include international law in his famous pure theory of law. However, the inclusion of international law into pure theory has caused certain “impurities” within the theory, problematizing the relationship between international and municipal legal systems. This article determines two main impurities in Kelsen’s account of the relationship between international law and municipal law. The first is caused by the notion of basic norm. It is defended that although this notion is very problematic and it has been challenged by many scholars in the past, it is not possible to get rid of the basic norm while continuing to support Kelsen’s normative positivism based on the dualism of “is” and “ought”. The second impurity relates to the prioritization of international and municipal legal orders. Kelsen shows a certain tendency to accept the supremacy of international law over municipal law. Meanwhile, he also acknowledges that supremacy of municipal legal order over international law could also be established. It all depends on which basic norm one presupposes to start with: the basic norm of international law or that of national legal system. It is argued that, after illustrating the unity of these two legal systems, it is frivolous to assert that one is superior to the other.
Kelsen est le seul théoricien positiviste à présenter une théorie cohérente du droit international. Alors que d’autres, comme Austin et Hart, continuent de douter du caractère juridique du droit international, Kelsen s’aventure à inclure le droit international dans sa célèbre théorie pure du droit. Cependant, l’inclusion du droit international dans la théorie pure a importé certaines “impuretés” dans la théorie, problématisant la relation entre les systèmes juridiques internationaux et municipaux. Cet article relève deux impuretés principales dans le compte rendu de Kelsen sur la relation entre le droit international et le droit municipal. La première est causée par la notion de norme de base. Il est défendu que bien que cette notion soit très problématique et qu’elle ait été contestée par de nombreux chercheurs dans le passé, il n’est pas possible de se débarrasser de la norme de base tout en continuant à soutenir le positivisme normatif de Kelsen basé sur le dualisme du “est” et du “devrait”. La seconde impureté concerne la hiérarchisation des ordres juridiques internationaux et municipaux. Kelsen montre une certaine tendance à accepter la suprématie du droit international sur le droit municipal. Entre temps, il reconnaît également que la suprématie de l’ordre juridique municipal sur le droit international pourrait également être établie. Tout dépend de la norme de base que l’on présuppose au départ: la norme de base du droit international ou celle du système juridique national. On fait valoir qu’après avoir illustré l’unité de ces deux systèmes juridiques, il est futile d’affirmer que l’un est supérieur à l’autre.
