En su estado actual, la Red Natura 2000 abarca proporciones importantes del territorio de Espana. Sin embargo, los intentos de conservar los hábitats y sus especies en las zonas de la Red Natura 2000 deben hacer frente a una amplia gama de incertidumbres y lagunas de conocimiento. Este artículo analiza cómo el Tribunal de Justicia de la Unión Europea tiene presente el principio de precaución a la hora de resolver casos relacionados con la conservación de los hábitats y la vida silvestre. En primer lugar, el artículo expone el derecho derivado, profundizando en las obligaciones relativas a la Red Natura 2000, para después comentar la respectiva jurisprudencia.
The Natura 2000 network encompasses a significant proportion of the Spanish territory. The actions carried out in order to achieve the Habitats directive goals within the different conservation areas are fraught with uncertainty. The article aims at analysing the manner in which the Court of Justice of the EU applies the precautionary principle in adjudicating nature conservation cases with respect to the Natura 2000 network. Firstly, the article describes the procedural and substantive conditions laid down under the nature protection directives. Secondly, the article comments on the case law of the CJEU.
