El propósito de este artículo es dar cuenta del cambio que existe en la manera de producir conocimiento jurídico, el cual hace ruptura contra un reduccionismo epistemológico que no logra explicar las complejidades de los problemas actuales. Lo anterior, para contribuir al diálogo sobre la configuración de un conocimiento conectado con las necesidades de los contextos humanos-no humanos, otorgando una nueva significación al derecho como objeto de estudio complejo y a la relación con el sujeto-jurídico cognoscente. Para ello, en una primera parte, se conceptualiza lo que se entiende por enfoques complejos, para luego, identificar su presencia en una muestra representativa de investigaciones y propuestas jurídicas. A partir de este acercamiento, se proponen criterios epistemológicos para orientar la creación de un conocimiento jurídico complejo.
The purpose of this article is to account for the change that exists in the way of producing legal knowledge, which breaks against an epistemological reductionism that fails to explain the complexities of current problems. The foregoing, to contribute to the dialogue on the configuration of knowledge connected to the needs of human-non-human contexts, giving a new meaning to law as a complex object of study and to the relationship with the knowing legal-subject. To do this, in the first part, what is understood by complex approaches is conceptualized, and then its presence is identified in a representative sample of investigations and legal proposals. Based on this approach, epistemological criteria are proposed to guide the creation of complex legal knowledge.
