La configuración del régimen jurídico de la responsabilidad concurrente de las Administraciones públicas no ha estado exenta de cierto debate a nivel doctrinal desde el primer momento en que apareció en un texto legal. Dicho debate no ha sido ajeno a la función consultiva, que ha participado arrojando luz en aquellos casos en los que los daños alegados por los ciudadanos hubieran podido ser causados por la intervención concurrente de diversas Administraciones. Este estudio recoge la evolución de la normativa que regula la materia, los pronunciamientos al respecto del Consejo de Estado y la interpretación del Tribunal Supremo, y analiza, a través de su último pronunciamiento sobre esta cuestión, la doctrina de la Comisión Jurídica Asesora de la Generalidad de Cataluña.
The configuration of the legal regime of the concurrent liability of Public administrations has not been exempt from certain debate from the first moment that appeared in a legal text. This debate has not been alien to the advisory function, which has participated by clarifying those cases in which the damages alleged by citizen could have been caused by the concurrent intervention of various Administrations. This study collects the evolution of the legal regime that regulates the matter, the pronouncements of the Council of State and the interpretation of the Supreme Court, and analyses, through its last pronouncement about that matter, the doctrine of the Legal Advisory Commission of the Generalitat of Catalonia.
