A lo largo del presente comentario vamos a ir analizando el reciente Auto de la Audiencia Provincial de Barcelona, Sección 15.ª, de 17 de junio de 2021 (ECLI:ES:APB:2021:5058A) donde se aborda el problema de la extralimitación o ultra vires del Texto Refundido de la Ley Concursal (TRLC), aprobado por el Real Decreto Legislativo 1/2020, en materia exoneración pasivo insatisfecho y, en concreto, sobre el tratamiento del crédito público. La exoneración del crédito público bajo la regulación contenida en el artículo 178bis de la Ley Concursal dio lugar a interpretaciones diversas por los tribunales de lo mercantil lo que propició que el Tribunal Supremo en de 2 de julio de 2019 aclarase la sumisión del crédito público al plan de pagos en la parte de crédito privilegiado, interpretación que no se ha respetado en la refundición.
Igualmente haremos algunas reflexiones sobre el nuevo régimen previsto en el Anteproyecto de Ley de Reforma de la Ley Concursal aprobado en el Consejo de Ministros de 3 de agosto de 2021.
Throughout this commentary we will be analysing the recent decision of the Barcelona Provincial Court, 15th Section, of 17 June 2021 (ECLI:ES:APB:
2021:5058A) which addresses the problem of the extralimitation or ultra vires of the Consolidated Text of the Insolvency Act (TRLC), approved by Royal Legislative Decree 1/2020, on the exoneration of unsatisfied liabilities and, specifically, on the treatment of public credit. The exoneration of public credit under the regulation contained in article 178bis of the Insolvency Act gave rise to different interpretations by the commercial courts, which led the Supreme Court to clarify the submission of public credit to the payment plan in the part of privileged credit, an interpretation that has not been respected in the recast. We will also make some reflections on the new regime envisaged in the Draft Bill for the Reform of the Insolvency Act approved by the Council of Ministers on 3 August 2021.
