Las ventajas con las que cuenta un acuerdo de refinanciación preconcursal (en un futuro próximo, plan de reestructuración) son muchas con respecto a cualquier renegociación de deuda alcanzada entre un deudor y algunos de sus acreedores ex autonomía de la voluntad. De ahí la importancia de saber delimitar con exactitud cuál es su presupuesto objetivo, o momento a partir del cual los escudos protectores de ese acuerdo de refinanciación habrán de surtir efecto. En este trabajo, se analizan los cambios producidos en esta cuestión: primero, tras la publicación de la Directiva comunitaria de 2019; y segundo, con el nuevo Anteproyecto de Ley de reforma concursal.
The legal protection of a pre-bankruptcy refinancing agreement (in a near future, restructuring plan) is quite obvious with respect to any debt renegotiation reached between a debtor and some of his creditors, ex art. 1255 CC. Hence the importance of knowing exactly the precise moment when this specific protective treatment should be provided to a debt renegotiation. In this work, we analyze the latest changes suffered in this subject: firstly, after the publication of the 2019 Community Directive; and secondly, with the new Bankruptcy Reform Bill which is being recently published.
