La Ley de Enjuiciamiento civil permite en determinados casos la intervención de terceros en el procedimiento que, originariamente, no sean parte. El artículo analiza las instituciones y mecanismos procesales para su incorporación. Además, se realiza un estudio de la evolución jurisprudencial sobre los efectos, límites y posición jurídica que adquieren en el proceso una vez se han personado en el mismo en atención a cada caso. El objetivo de estas instituciones es proteger los derechos e intereses legítimos de las personas que pudiesen resultar afectadas por una resolución judicial.
The Civil Procedure Law allows in certain cases the intervention of third parties in the proceedings who, originally, are not participants. The article analyses the institutions and mechanisms for their incorporation. In addition, a study is made of the evolution of case law on the effects, limits and legal position that they acquire in the proceedings once they have been included. The aim of these institutions is the protection of the rights and interests of people who might be affected by a judicial decision.
