La prohibición de la sucesión contractual del Derecho común contrasta ampliamente con la regulación de pactos sucesorios en los Derechos civiles especiales o forales de algunos territorios (Aragón, Islas Baleares, Cataluña, Galicia, Navarra y País Vasco), donde se han convertido en una poderosa herramienta de planificación sucesoria.
En este contexto, los pactos sucesorios de eficacia de presente constituyen una figura controvertida, atendida su naturaleza híbrida y los importantes beneficios fiscales de que disfrutan, fruto de su equiparación con las transmisiones mortis causa.
Así lo demuestra la doctrina administrativa, caracterizada por la disparidad de criterios tanto en relación con el IRPF como, recientemente, respecto al ISD, como reflejo unas veces de las singularidades de las normativas autonómicas y, otras veces, de la voluntad velada de recortar su favorable tratamiento fiscal.
Desde esta perspectiva, la Ley de Medidas de Prevención y Lucha contra el Fraude Fiscal de 2021 ha modificado sustancialmente su régimen jurídico, incorporando sendos ajustes en la legislación del IRPF y del ISD con vistas a evitar la realización de operaciones abusivas, lo que nos sitúa ante un nuevo escenario en este ámbito.
The prohibition of contractual succession under Common Law contrasts widely with the regulation of succession agreements in the special or regional civil Law of some territories (Aragon, Balearic Islands, Catalonia, Galicia, Navarra and the Basque Country), where they have become a powerful estate planning tool.
In this context, the succession agreements of present effectiveness constitute a controversial figure, considering their hybrid nature and the important tax benefits they enjoy, as a result of their assimilation to mortis causa transmissions.
This is demonstrated by the administrative doctrine, characterized by the disparity of criteria both in relation to personal income tax and, recently, with respect to inheritance and gift tax, as a reflection sometimes of the singularities of the regional regulations and, other times, of the veiled will to cut its favorable tax treatment.
From this point of view, the Act on Prevention and Fight against Tax Fraud –approved in 2021– has substantially modified its legal regime, incorporating some adjustments in the personal income tax and inheritance and gift tax legislation with a view to preventing abusive operations, which places us before a new scenario in this area.
