En 2021, la humanidad se enfrenta a una edad digital «casi» sin derechos digitales. Los paradigmas del mundo han cambiado. El ser humano afronta mutaciones que, desde las mentalidades a la economía, la cultura, la política e, incluso, las claves cognitivas de nuestra identidad, están cambiando profundamente los ejes de cómo organizamos nuestra convivencia. Incluso alteran nuestra propia manera de ser. Y todo ello sin un entorno de seguridad jurídica que nos guíe en la transición de la era analógica a la digital. Es aquí donde nace el importantísimo papel de los derechos digitales.
Este artículo aborda el contexto, concepto y desarrollos de esta nueva generación de derechos, teniendo en cuenta su positivización vigente en la Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales, así como las novedades que incorpora la Carta de Derechos Digitales de España. Por último, se examinan los próximos pasos en la evolución de los derechos digitales, evolución que incluso pudiera desembocar a medio plazo en la creación de un nuevo orden jurisdiccional para los asuntos digitales adaptado a los procedimientos y tiempos de resolución del mundo digital.
In 2021, humanity faces a digital age with «almost» no digital rights. The world’s paradigms have shifted. Human beings are facing alterations that, from mindsets to the economy, culture, politics and even the cognitive basis of our identity, profoundly change the axes of how we organise our living together. They even alter our very way of being. And all this without an environment of legal certainty to lead us through the transition from the analogue to the digital era. This is where the all-important role of digital rights emerges.
This paper addresses the context, concept and developments of this new generation of rights, taking into account their current codification in the Organic Law 3/2018, of 5 December, on Personal Data Protection and the guarantee of digital rights, as well as the novelties incorporated in the Spanish Digital Rights Charter. Finally, the next steps in the evolution of digital rights are examined, an evolution that could even lead in the medium term to the creation of a new jurisdictional order for digital legal disputes adapted to the procedures and resolution times of the digital world.
