Dentro de las varias enmiendas propuestas en 2014 para la Constitución ecuatoriana aprobada en 2008, consta la posibilidad de regular la acción de protección por medio de limitaciones de admisibilidad. La propuesta consiste en aumentar la siguiente frase al final del Artículo 88 de la Constitución: “[l]a ley regulará los casos en los cuales se abuse de esta acción y, por lo tanto, pueda ser inadmitida”. El presente artículo busca identificar las principales implicaciones jurídicas de la propuesta y los problemas que puede llegar a presentar en caso de ser aprobada. De igual manera, busca exponer las limitaciones normativas y sistemáticas ya existentes a la acción de protección y a las acciones constitucionales en general, y sostiene que la creación de nuevas limitaciones y parámetros de inadmisibilidad disminuye su efectividad y restringe la posibilidad de que cumpla con su finalidad: la protección y la tutela efectiva de derechos, y la creación de un sistema en el que exista control sobre los actos del poder público.
Within the several amendments to the Ecuadorian Constitution that were proposed in 2014, there is the possibility of regulating the writ of amparo through restrictions on its admissibility. The proposal is to increase the following sentence at the end of Article 88 of the Constitution: “[t]he law shall regulate the cases in which there is abuse of this action and, therefore, it may be declared inadmissible”. This essay seeks to identify the main legal implications of the proposal. Similarly, it exposes the already existing normative and systematic limitations to the writ of amparo, and to all the other writs that are protected by the constitution. We argue that the establishment of new limitations and parameters of inadmissibility decreases the effectiveness of the writ and restricts its ability to fulfill its purposes of effectively protecting rights and preventing the creation of a system in which there is control over the acts of public power.
