Se analiza la STJUE de 19 de diciembre de 2019, asunto C-263/18 (Tom Kabinet), por un caso de violación de los derechos de autor por la empresa titular de un sitio de Internet en el que se gestiona un mercado virtual de libros electrónicos «de segunda mano». Para la prestación del servicio se debería haber contado con el consentimiento de los titulares de las obras para la reventa de éstas ya que, conforme lo están haciendo, dado que no hay un desgaste del libro electrónico, que siempre permanece inalterado en el tiempo, el autor solo se lucrará con la primera venta y no con las ulteriores, perdiendo rendimiento económico; admitir que el acto realizado por Tom Kabinet se enmarca dentro de la distribución, supondría un lucro cesante para el autor, y abriría la puerta a que el mercado de segunda mano de los libros electrónicos se disparase causando un perjuicio económico a los autores.
The judgement of the Court of Justice of the European Union of 19 December 2019, Case C-263/18 (Tom Kabinet), in a case of copyright infringement by the owner of an Internet site which operates a virtual marketplace for «second-hand» e-books, is analysed. The service should have been provided with the consent of the owners of the works for the resale of these works, since, as they are doing so, given that there is no wear and tear on the e-book, which always remains unchanged over time, the author will only profit from the first sale and not from subsequent sales, thus losing out financially; admitting that the act carried out by Tom Kabinet is part of distribution would mean a loss of profit for the author, and would open the door for the second-hand market for e-books to skyrocket, causing economic damage to authors.
