RCUD 2656/2010. Pensión de jubilación reconocida a un trabajador afiliado al RETA que tiene concedido el aplazamiento en el pago de cuotas, procediendo el INSS a suspender el pago de la pensión cuando incumple los plazos concedidos. Posteriormente abona todas las cuotas y se reanuda el pago de la pensión pero se deja sin abonar las mensualidades correspondientes al periodo transcurrido desde que incumplió los plazos hasta que abonó la totalidad de la pensión. La sentencia entiende que han de abonarse todas las mensualidades.RCUD 4312/1997 Trabajadora que agota el periodo máximo de incapacidad laboral transitoria, no procede el alta por curación, no ha sido declarada en incapacidad permanente y la Dirección Provincial de la TGSS le da de baja en el RETA por agotamiento del plazo máximo de la incapacidad temporal. .La sentencia considera esta situación asimilada al alta.
