La movilidad humana transnacional por motivos medioambientales es una realidad, sin embargo, estos éxodos humanos tienden a ser invisibilizados por la comunidad internacional, pues nos encontramos ante la ausencia de un instrumento jurídico vinculante único que desarrolle el fenómeno plenamente y que haga exigible a los Estados la toma de medidas para mitigar, controlar y actuar ante él. Así, este artículo contiene una aproximación general al problema de la movilidad humana transnacional por motivos medioambientales. Para ello, sobre este éxodo ambiental se enlistarán las características comunes, sus cifras relevantes y con la intención de esclarecer aún más el fenómeno, se presentarán casos prácticos del mismo como el del terremoto de Haití de 2010. Además, comparte un estudio de las disposiciones internacionales que guardan relación de forma directa o indirecta con esta clase de movilidad. Dicho estudio se ha dividido en tres apartados comprensivos de siete regímenes, así: (i) la respuesta internacional en instrumentos generales -conformada por el régimen internacional y regional del refugio, del desplazamiento interno y del Derecho internacional de los derechos humanos, de la acción humanitaria y del hábitat; (ii) la respuesta internacional en instrumentos ambientales– conformada por el régimen internacional del cambio climático, de la reducción del riesgo de desastre y del desarrollo sostenible; y (iii) la respuesta nacional colombiana al fenómeno, siendo este país uno de los mayores emisores de desplazados internos a nivel mundial. Finalmente, se realiza una profundización especial de la que es la hoja de ruta y caja de herramientas más completa del fenómeno: la Agenda para la protección de las personas desplazadas a través de fronteras en el contexto de desastres y cambio climático de 2015. Y también, se aporta algunas opciones respecto a la mejora de la protección jurídica de este éxodo. Todo con la esperanza de que el resultado final visibilice esta forma de movilidad humana y evidencie la necesidad de protección de las vidas humanas aquí afectadas por motivos medioambientales.
Transnational human mobility due to environmental reasons is a reality. However, these displacements tend to be invisible by the international community, since we are faced with the absence of a single binding legal instrument that fully develops the phenomenon and makes it mandatory for the States to take measures to mitigate, control and act against it. This article includes a general approach to the problem of transnational human mobility for environmental reasons. To this end, the common characteristics and relevant figures will be listed on this environmental exodus, and with the intention of further clarifying the displacement, practical cases will be presented, such as the 2010 Haiti earthquake. Also, the study develops the international instruments that are directly or indirectly related to this kind of mobility. This study has been divided into three comprehensive sections of seven chapters, as follows: (i) the international response in general instruments - which incorporates international and regional refugee regime, internal displacement and international regimes of international law of the human rights, humanitarian action and habitat; (ii) the international response in environmental instruments - made up of the international climate change regime, disaster risk reduction, and sustainable development; and (iii) the Colombian national response to the displacement, this country being one of the largest emitters of internally displaced persons worldwide. Finally, a special deepening of what is the most complete roadmap and toolbox of the phenomenon will be carried out: The Agenda for the protection of people displaced across borders in the context of disasters and climate change of 2015. And, some options will be provided regarding the improvement of the legal protection of this exodus.
