Cuando se comparte la pensión de viudedad entre una cónyuge superviviente y otra cónyuge histórica -lo que ocurre aquí porque el causante se había divorciado previamente y concurren los derechos de dos beneficiarias a la misma- la merma en la pensión que así se obtiene debiera mantenerse mientras la prestación se lucra. No obstante, el Tribunal Supremo resuelve que la pensión de viudedad que obtiene la última esposa sí acrece cuando fallece quien fuera la histórica.
When the widowhood pension is shared between the surviving spouse and the historical spouse - which happens here because the deceased had previously divorced and the rights of two beneficiaries to it concur - the reduction in the pension thus obtained should be maintained while the benefit profit. However, the Supreme Court decides that the widow's pension obtained by the surviving spouse does increase when the former spouse dies.
