Desde finales de 2018 se reconoce el derecho a la «desconexión digital» en el ámbito laboral. Este nuevo contexto exige una relectura del derecho a para analizar el estado de la cuestión del mismo, tanto desde una vertiente normativa como convencional. Luego, se hará un análisis jurídico comprobando la idoneidad de la norma, los déficits con los que cuenta y las eventuales reformas que se pueden llevar a cabo.
Since the end of 2018, the right to «digital disconnection» has been recognized in the workplace. The confinement and subsequent situation experienced in the different phases by the largest health crisis in recent history has led to an increase in the constant use of mobile electronic devices. The constant use of smartphones or tablets is increasing, as they facilitate the performance of work from anywhere at any time. Furthermore, due to the preponderance given to remote work, inevitable due to the situation of COVID-19. This new context requires a rereading of the right to analyze the state of the question of it, both from a normative and conventional perspective. Then, a legal analysis will be carried out, verifying the adequacy of the rule, the deficits it has and the possible reforms that can be carried out.
