El presente trabajo tiene por objeto analizar el régimen jurídico de la diligencia en las fuentes romanas y su conexión con los conceptos vinculados a ella, como la buena fe, el dolo y, especialmente, la culpa, examinando los modelos de conducta a los que se remiten los textos para delimitar la imputabilidad por insobservancia de la misma, en concreto, la diligentia del bonus paterfamilias, la exactissima diligentia y la diligentia quam in suis rebus adhibere solet, núcleo de reflexión sobre la que los juristas romanos estudian esta materia.
This paper analyzes the legal regime of diligence in Roman sources and its connection with the concepts related to it, such as good faith, fraud and, especially, guilt, examining the models of conduct to which the texts refer to delimit the imputability for non-observance of the same, specifically, the diligentia quam in suis, the diligentia bonus paterfamilias, the exactissima diligentia and the diligentia quam in suis rebus adhibere solet, core of reflection on which the Roman jurists study the diligence.
