Este trabajo examina la evolución de las instituciones que conforman el mercado de trabajo en España para señalar que las políticas laborales están condicionadas, en gran medida, por las estructuras de negociación y los incentivos de los agentes sociales. Para ello se hace una radiografía histórica de la CEOE, la UGT y CC. OO., así como de los acuerdos y pactos sociales firmados hasta la fecha. Este enfoque neoinstitucional quiere aportar nuevas ideas al debate sobre las reformas necesarias en el ámbito de la negociación colectiva. Un debate dominado hasta la fecha por posturas irreconciliables que van desde la máxima flexibilidad y descentralización (enfoque económico) hasta la recuperación de la centralidad negociadora y la reforma de la empresa española (enfoque sociológico y politólogo). Nuestra propuesta anima a pensar en incentivos institucionales que ayuden a las partes negociadoras a ser más responsables ante sus miembros y la sociedad, lo cual pasa por una reforma de sus organizaciones y sus lógicas de acción colectiva.
This paper examines the evolution of labor market institutions in Spain to point out that labor policies are conditioned, to a great extent, by the (formal and informal) rules that guide the negociations among social agents. For this, we focus on the historical evolution of the main employers’ associations and trade unions (the CEOE, the UGT and CC. OO.), as well as on the tripartite and bipartite pacts they have been involved so far.
This neo-institutional approach contributes new ideas to the debate on the necessary reforms in the field of collective bargaining.
A debate dominated to date by irreconcilable positions ranging from maximum flexibility and decentralization (economic approach) to the recovery of negotiating centrality and the reform of the Spanish company (sociological approach). Our proposal encourages thinking about institutional incentives that help the negotiating parties to be more responsible to their members and society, which involves a reform of their organizations and their collective action logic.
