El presente artículo estudia los principales fundamentos teóricos y antecedentes históricos del reconocimiento de los derechos de la Naturaleza y la línea jurisprudencial desarrollada por la Corte Interamericana de Derechos Humanos con relación al medio ambiente y los recursos naturales. La autora analiza los aportes de la referida Corte a la Jurisprudencia de la Tierra a partir del cambio de enfoque antropocéntrico propuesto en su opinión consultiva núm. 23 de 2017 y sugiere el reconocimiento de los derechos de la Naturaleza mediante la interpretación del artículo 26 de la Convención Americana sobre Derechos Humanos en aras de impulsar en la región la consiguiente inmediata protección simultánea y armónica de los derechos fundamentales de la Naturaleza y de las personas al medio ambiente.
This article studies the main theoretical and historical antecedents of the recognition of the rights of Nature and the jurisprudential line developed by the Inter-American Court of Human Rights in relation to the environment and natural resources. The author analyzes the contributions of the aforementioned Court to the Jurisprudence of the Earth from the change of anthropocentric approach proposed in its advisory opinion no. 23 of 2017 and suggests the recognition of the rights of Nature through the interpretation of Article 26 of the American Convention on Human Rights in order to promote in the region the immediate simultaneous and harmonious protection of the fundamental rights of Nature and people´s rigths to a healthy environment.
