This paper aims to analyze the philosophical traditions studied by the discipline called Metaethics, especially the distinction between Non-cognitivist and cognitivist postures, in order to identify the theoretical presuppositions that inspire the school of thought commonly known as North American Legal Realism. The methodology applied is based on the critical review of concepts developed by the authors that best represent non-cognitivist metaethics, allowing the reconstruction of the fundamental ideas that were developed within the theoretical framework of the North-American Legal Empiricism.
O presente texto pretende analisar as tradições filosóficas estudadas pela disciplina da Metaética, principalmente a distinção entre correntes cognitivistas e não cognitivistas, de modo a identificar os pressupostos teóricos que inspiram a escola de pensamento comumente denominada de Realismo jurídico Norte-Americano. A metodologia utilizada baseia-se na revisão crítica dos conceitos desenvolvidos pelos autores que melhor representam a tradição metaética não cognitivista de modo a reconstruir tais ideias dentro da matriz teórica do empirismo jurídico Norte-Americano.
