El Impuesto sobre el Valor de la Producción de la Energía Eléctrica, aprobado en el año 2012, ha sido cuestionado tanto desde la perspectiva del ordenamiento constitucional como del Derecho de la Unión Europea. Recientemente, el Tribunal de Justicia de la Unión Europea se ha pronunciado sobre esta cuestión declarando la compatibilidad del impuesto español con el Derecho de la Unión Europea, precisando el concepto de impuesto indirecto en el ámbito de los impuestos especiales y el alcance de las obligaciones de los Estados a la hora de introducir beneficios fiscales motivados por objetivos medioambientales de la Unión Europea.
The Spanish Tax on the Value of Electricity Production, approved in 2012, has been questioned both from the perspective of constitutional and European Union law. Recently, the CJEU has ruled on this issue declaring the compatibility of the Spanish Law with EU Law, specifying the concept of indirect tax in the field of excise duties and the range of Member States obligations in order to implement tax incentives connected with EU environmental objectives.
