El presente trabajo tiene como objeto el estudio del derecho fundamental a la libertad de circulación y sus límites en el marco de los sucesivos estados de alarma declarados en España como consecuencia de la pandemia ocasionada por la COVID-19. Con esta finalidad se analizan las principales medidas adoptadas por el Gobierno de España para hacer frente a la crisis sanitaria, su necesidad y proporcionalidad, así como el marco jurídico que resulta más adecuado (el estado de alarma o el estado de excepción) para legitimar tan severas restricciones de derechos fundamentales
This paper aims to study the fundamental right to freedom of movement and its limits within the framework of the successive states of alarm declared in Spain as a consequence of the pandemic caused by COVID-19. For this purpose, it analyses the main measures adopted by the Government of Spain to face the health crisis, their need and proportionality, as well as the most appropriate legal framework (the state of alarm or the state of exception) to legitimize such severe restrictions on fundamental rights
