This article focuses on the model of the UN internal system of administration of justice, which is essentially the only one in the context of the international organizations providing for a two-tiered judicial mechanism of resolving (among others) the employment-related disputes arising between the Administration and the staff members. In 2007, the General Assembly of the United Nations approved the establishment of a two-tiered judicial system, which became operational on 1 July 2009. This formal system of the administration of justice is comprised of the UN Dispute Tribunal, as the first-instance Tribunal, and the UN Appeals Tribunal (second instance), as the highest administrative Tribunal within the United Nations. Under the respective seven chapters (I-VII) the article enlarges upon the administration of justice system at the UN prior to 2009, the established new two-tiered system of UN Tribunals in 2009, the right to appeal against the first-instance Tribunal’s (UNDT or UNAT) judgments, as well as upon the grounds of appeal and the key characteristics of the appeals proceedings.
Cet article examine le modèle du système interne d’administration de la justice de l’ONU, qui est essentiellement le seul, dans le cadre des organisations internationales, à prévoir un mécanisme juridictionnel à deux degrés pour résoudre (entre autres) les litiges relatifs à l’emploi nés entre l’administration et les membres du personnel. En 2007, l’Assemblée générale des Nations unies a approuvé l’établissement d’un système juridictionnel à deux degrés, qui est devenu opérationnel le 1er juillet 2009. Ce système formel d’administration de la justice comprend le Tribunal du contentieux administratif des Nations unies comme tribunal de première instance, et le Tribunal d’appel des Nations unies (seconde instance) comme juridiction administrative suprême au sein de l’ONU. Dans sept chapitres (I-VII), cet article expose le système d’administration de la justice des Nations unies avant 2009, le nouveau système juridictionnel à deux degrés établi au sein de l’ONU en 2009, le droit de faire appel contre les arrêts du Tribunal de première instance (Tribunal du contentieux ou Tribunal administratif), ainsi que les motifs d’appel et les principales caractéristiques de la procédure d’appel.
