Ante los numerosos pronunciamientos judiciales sobre la condición de consumidor, se evidencia que la definición contenida en el Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias, no se adecúa a la realidad social en la que participan los consumidores con ánimo de lucro como operadores económicos en el marco de la economía colaborativa. En este trabajo se analizan las definiciones de consumidor, su adecuación y se realizan propuestas para elaborar una categoría que los comprenda.
In face of the many judicial decisions on the condition of consumer, it is clear that the definition contained in the Royal Legislative Decree 1/2007, of 16th of November, that enacts the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws is not suited for the current social reality in which profit-seeking consumers participate as economic operators within the context of the collaborative economy. This paper analyses the definitions of consumer and their suitability, and also presents proposals for the elaboration of a category that encompasses them all.
