La resolución judicial objeto del presente comentario resuelve de manera satisfactoria tres cuestiones claves vinculadas al ámbito del DIP: la calificación de la institución de la prescripción, la ley aplicable a un pleito de naturaleza laboral con dimensión transfronteriza y por último, la interacción entre los bloques normativos que entran en juego. En particular, la decisión judicial descarta la calificacióncomo procesal de la institución de la prescripción y deriva de ello de forma correcta la aplicación de la Lex Contractus (en este caso, la ley dominicana). Sorprende en todo caso la ausencia de toda referencia a la norma de conflicto aplicable al litigio resuelto, concretada en el Reglamento Roma I sobre ley aplicable a las obligaciones contractuales.
The judicial resolution that is the subject of this comment satisfactorily resolves three key issues related to the scope of the International Private Law: the qualification of the statute of limitations, the determination of the law applicable to a lawsuit of a labor nature with a cross-border dimension and finally, the interaction between the normative blocks that come into play in the litigation case. Inparticular, the resolution discards the procedural qualification of the prescription and derives from it the application of the Lex Contractus (Dominican Law) to it. In any case, the absence of any reference to the conflict rule applicable to litigation, such as the Rome I Regulation on the law applicable to contractual obligations, is surprising.
