El Tribunal Supremo considera que el Real Decreto Legislativo 1/2013, de 29 de noviembre, se ha extralimitado con respecto al mandato de legislación delegada recibido, de tal forma que el artículo 4.2 de la norma incurre en ultra vires al haber modificado, sin estar previsto en la autorización legal de refundición de diversos textos normativos, la redacción del derogado artículo 1.2 de la Ley 51/2003, mantenida en sus propios términos en la Ley 26/2011. El Alto Tribunal entiende que además ese cambio ha sido de carácter sustancial, al reconocer un grado de discapacidad del 33% " a todos los efectos" a quienes tengan la condición de pensionistas de Incapacidad permanente en cualquiera de sus grados en vez de hacerlo únicamente a efectos de los derechos reconocidos en la derogada Ley de igualdad de oportunidades, no discriminación y accesibilidad universal de las personas con discapacidad de 2003.
The Supreme Court considers that Royal Legislative Decree 1/2013, of November 29, has exceeded the mandate of delegated legislation received, in such a way that art. 4.2 of the norm incurs "ultra vires" by having modified, without being foreseen in the legal authorization of recasting of various normative texts, the wording of the repealed art. 1.2 of Law 51/2003, maintained in its own terms in Law 26/2011. The High Court understands that this change has also been of a substantial nature, recognizing a degree of disability of 33% "for all intents and purposes" to those who have the status of permanent disability pensioners in any of their degrees instead of only to Effects of the rights recognized in the repealed Law of Equal Opportunities, Non-discrimination, and Universal Accessibility of Persons with Disabilities of 2003.
