La jurisprudencia del Tribunal Europeo de Derechos Humanos ha aflorado con apoyo en diversos métodos interpretativos: a) El principio de indivisibilidad de los derechos fundamentales; b) El principio de igualdad y no discriminación; y, c) La conexión de derechos, método interpretativo a través del cual el Tribunal Europeo de Derechos Humanos da cabida a derechos no expresamente cubiertos por el texto convencional. La doctrina sentada por el Tribunal Europeo de Derechos Humanos en aplicación e interpretación del Convenio Europeo de Derechos Humanos ha permitido la construcción de unos principios esenciales en materia social y económica. Y, al mismo tiempo, ha dado respuesta a las cuestiones planteadas ante las medidas adoptadas durante la crisis económica. Los ejemplos son abundantes. Nos centraremos en los más destacados que se refieren a la dimensión social del derecho de propiedad, del derecho a un proceso de duración razonable y del derecho de igualdad y no discriminación.
The case-law of the European Court of Human Rights is based in several interpretation criterion: a) The principle of indivisibility of fundamental rights; b) The principle of equality and non-discrimination; and c) The connection of the rights, interpretation criterion that allows the European Court of Human Rights to integrate rights not specifically covered by the Convention. The European Court of Human Rights understands the European Convention of Human Rights as an alive instrument, that has to be interpreted within the facts and the timing of each case. The European Court of Human Rights legal doctrine in the application and interpretation of the European Convention on Human Rights has allowed to draw essential principles in the social market economy. We have many examples. This paper seeks to explore the social dimension of the property right, the right to a fair trial within a reasonable time, the right of appeal and the right to equality and non-discrimination.
