La complejidad de los Reglamentos europeos de coordinación en materia de Seguridad Social ha hecho muy difícil su aplicación por parte de las instituciones de los diferentes Estados miembros. En el caso español, destacan, principalmente, los problemas vinculados con el acceso y cálculo de las pensiones de los migrantes europeos, sobre todo, de jubilación. Hace tiempo que esta cuestión atormenta a instituciones, jueces y tribunales españoles, tanto que han sido numerosas las cuestiones prejudiciales interpuestas en este ámbito. Sin embargo, los pronunciamientos del Tribunal de Luxemburgo, lejos de clarificar la cuestión, han suscitado más problemas que todavía siguen sin resolverse.
The application of the EU Regulations on Social Security coordination by the institutions of the different Member States has been really difficult due to its complexity. In Spain, the main problems are related to the access and calculation of EU migrants’ pensions, especially the retirement ones. The Spanish institutions, judges and courts have experienced many applications problems. So that, they have requested for many preliminary rulings on this matter. However, the rulings of the Luxembourg Court not only didn’t solve these issues but also raised the problems which remain unsettled.
