El presente estudio tiene por objetivo analizar una nueva aproximación al problema migratorio en el Derecho de la Organización Internacional del Trabajo. Se trata de la Iniciativa sobre la contratación equitativa, promovida por la OIT en los últimos años. La Iniciativa pretende hacer frente a los abusos que sufren los trabajadores, en particular de las agencias de empleo públicas y privadas. Se destaca el papel cada vez más relevante de estos actores en el funcionamiento eficiente y equitativo de los mercados de trabajo. De este modo, el propósito del nuevo enfoque es contribuir a la prevención de la trata de personas y del trabajo forzoso, promover los derechos de los trabajadores, y en especial de los trabajadores migrantes, contra las prácticas abusivas y fraudulentas en el proceso de contratación, reducir el coste de la migración laboral y abordar los problemas de la migración en los países de origen, de tránsito y de destino.
The aim of this study is to analyse a new approach to the migration in the instruments of the International Labour Organisation. It deals with the Fair Recruitment Initiative, promoted by the ILO in recent years. The Initiative aims to address the abuses suffered by workers, in particular from public and private employment agencies. It highlights the increasingly important role of these actors in the efficient and fair functioning of labour markets. Thus, the purpose of this new approach is to contribute to the prevention of trafficking and forced labour, to promote the rights of workers and especially migrant workers against abusive and fraudulent practices in the recruitment process, to reduce the cost of labour migration and to face the problems of migration in countries of origin, transit and destination.
